Terms & Conditions

Last updated: November 2026

These Terms & Conditions govern your use of the Proper Guitar Lessons website and your purchase and use of any courses, digital products, memberships, assessments, coaching, feedback services or other products and services offered by Proper Guitar Lessons.

Please read these Terms & Conditions carefully before using the website or making a purchase.

By purchasing a product or service from Proper Guitar Lessons, you agree to these Terms & Conditions.

1. About Proper Guitar Lessons

Proper Guitar Lessons is operated by Toby Newcombe, trading as Proper Guitar Lessons.

Website: www.properguitarlessons.com

Email: [email protected]

Business address:

First Thatched Cottage, Trowley Bottom, Flamstead, Herts, AL3 8DR

In these Terms & Conditions, "Proper Guitar Lessons", "I", "me" and "my" refer to Toby Newcombe trading as Proper Guitar Lessons.

"You" and "your" refer to the person purchasing or using the website, product or service.

2. Who may purchase

You must be at least 18 years old to make a purchase from Proper Guitar Lessons.

A course or service may be used by someone under 18 where it is purchased or authorised by their parent or legal guardian.

Where a parent or guardian purchases a product for a child, the parent or guardian is responsible for the account and for supervising the child's use of the service where appropriate.

3. Products and services

Proper Guitar Lessons may offer products and services including:

  • Online guitar and music courses
  • Downloadable learning materials
  • Video lessons
  • Assessments
  • Personalised feedback
  • Coaching or tuition
  • Memberships or subscriptions
  • Community features
  • Other related digital products or services

The exact content, features, access period, price and any additional conditions applying to a product or service will be explained on the relevant sales or checkout page.

That information forms part of the agreement between you and Proper Guitar Lessons.

4. Orders and formation of the contract

When you place an order, you are offering to purchase the relevant product or service subject to these Terms & Conditions.

A contract is formed when your order and payment have been accepted and you receive confirmation of your purchase.

I reserve the right to refuse or cancel an order before acceptance where there is a genuine reason to do so, including an obvious pricing error, suspected fraud, payment failure or where the product or service is unavailable.

If payment has already been taken for an order that I cannot fulfil, it will be refunded.

5. Prices and payment

Prices will be clearly displayed before you complete a purchase.

Unless stated otherwise, prices are shown in the currency displayed at checkout and include any taxes that Proper Guitar Lessons is legally required to include.

Payments may be processed by third-party payment providers. Proper Guitar Lessons does not normally receive or store your complete payment-card details.

You are responsible for providing accurate billing and payment information.

If a payment is declined, reversed, refunded through a payment provider or subject to a valid payment dispute, access to the associated product or service may be suspended while the matter is resolved.

Nothing in this clause affects your legal right to dispute an incorrect or unauthorised payment.

6. Access to digital courses and content

Unless otherwise stated on the relevant sales page, digital products are supplied electronically.

You will normally receive access using the email address and account details associated with your purchase.

You are responsible for ensuring that:

  • Your email address is correct
  • You have a suitable internet connection
  • Your device and browser are capable of accessing the course platform
  • You keep your login information secure

Please contact me if you experience problems accessing something you have purchased.

7. Lifetime access

Some Proper Guitar Lessons products may be advertised as including lifetime access.

Where this term is used, it means access to the purchased course for the lifetime of that course as provided by Proper Guitar Lessons, subject to these Terms & Conditions and the continued operation of Proper Guitar Lessons and the technologies reasonably required to provide the course.

It does not guarantee that a particular website, software platform, video-hosting provider or technical system will remain available indefinitely.

Proper Guitar Lessons will not deliberately withdraw a lifetime-access product simply to require existing customers to purchase it again.

If a lifetime-access product must be permanently withdrawn, I will take reasonable steps where practicable to provide advance notice and, where reasonably possible, provide an alternative means of access or substantially equivalent replacement material.

Nothing in this section affects your statutory consumer rights.

8. Changes and updates to courses

I may occasionally update, improve, reorganise or replace lessons, exercises, videos, downloads or other course materials.

This allows courses to remain useful, accurate and relevant.

Updates may include changes to:

  • Lesson order
  • Exercises
  • Video content
  • Resources and worksheets
  • Technology or presentation
  • Examples and demonstrations

I will not intentionally make a material change that removes the essential content or benefit of a product you have already purchased without good reason.

Where a significant change materially affects something you have purchased, any rights or remedies available to you under consumer law will continue to apply.

9. Your statutory rights

Nothing in these Terms & Conditions removes or restricts any rights you have under applicable consumer law.

Where UK consumer law applies, digital content must meet the standards required by law, including being of satisfactory quality, fit for its intended purpose and as described.

Services must also be provided with the level of care and skill required by law.

If a product or service does not meet the standards required by law, you may be entitled to an appropriate remedy.

10. Cancellation rights for digital content

Consumers purchasing online will generally have a legal right to cancel certain contracts within 14 days.

Digital content that is supplied immediately is treated differently.

Where you request immediate access to digital content before the end of the 14-day cancellation period, I may ask you to:

  1. expressly consent to supply of the digital content beginning immediately; and
  2. acknowledge that you will lose your statutory right to cancel once supply of that digital content begins.

Where you have given that express consent and acknowledgement and digital content has begun to be supplied, your statutory 14-day right to cancel that digital-content purchase will normally end.

This does not affect your rights if the digital content is faulty, misdescribed or otherwise does not meet your statutory rights.

If Proper Guitar Lessons offers an additional refund promise, money-back guarantee or trial period for a particular product, the terms of that additional promise will be stated on the relevant sales page.

Any such guarantee is in addition to your statutory rights.

11. Cancellation rights for services

Where you purchase a service rather than digital content – for example personalised feedback, an assessment or coaching – you may have a statutory 14-day cancellation period.

If you expressly ask me to begin providing the service during that cancellation period and then cancel before the service is complete, you may be required to pay a reasonable amount for the portion of the service already supplied.

Where a service has been fully performed during the cancellation period following your express request and your acknowledgement that your cancellation right will be lost once the service is completed, the statutory right to cancel may end.

Your statutory rights remain unaffected.

12. Refunds

Refunds will be provided where required by law.

A change of mind does not automatically entitle you to a refund after digital content has begun to be supplied where you expressly requested immediate access and acknowledged the loss of your cancellation right.

If a particular Proper Guitar Lessons product includes a separate refund guarantee, trial or satisfaction promise, that policy will be clearly stated when you purchase it.

Please contact [email protected] if you believe you are entitled to a refund or if there is a problem with a purchase.

13. Subscriptions and recurring payments

Where Proper Guitar Lessons offers a subscription or recurring membership, the price, billing frequency and minimum commitment, if any, will be clearly displayed before purchase.

By purchasing a recurring subscription, you authorise the applicable payment provider to collect the stated recurring payment until the subscription is cancelled or otherwise ends.

You may cancel a recurring subscription using the cancellation method provided with the service or by contacting Proper Guitar Lessons.

Unless otherwise stated, cancellation will stop future renewal payments and access will normally continue until the end of the period already paid for.

Any statutory cancellation or cooling-off rights applicable to subscriptions remain unaffected.

If the price of an ongoing subscription is changed, reasonable advance notice will be provided and you will be given the opportunity to cancel before the new price takes effect where required.

14. Personal-use licence

When you purchase a Proper Guitar Lessons course or digital product, you are purchasing access to the material – you are not purchasing ownership of the intellectual property contained within it.

Unless expressly stated otherwise, you receive a limited, personal, non-exclusive and non-transferable licence to use the material for your own learning.

You may download or print worksheets and other resources where downloading or printing is provided or expressly permitted.

You must not, without written permission:

  • Share your account or login details with another person
  • Give another person access to a course you purchased for yourself
  • Copy or redistribute course videos
  • Screen-record or reproduce course lessons
  • Upload course material to another website, social network, file-sharing service or online platform
  • Sell, sublicense or commercially distribute any Proper Guitar Lessons material
  • Repackage Proper Guitar Lessons material as your own course or teaching product
  • Remove copyright or ownership notices
  • Use substantial parts of the course materials to create a competing product
  • Upload Proper Guitar Lessons materials into datasets or systems for the purpose of reproducing or commercially exploiting them

A parent or guardian may reasonably access an account used by their child for the purpose of supervising that child's learning.

15. Intellectual property

Unless otherwise stated, all original materials supplied by Proper Guitar Lessons – including videos, lesson structures, exercises, text, graphics, PDFs, worksheets, diagrams, branding, course names and downloadable materials – are owned by or licensed to Proper Guitar Lessons and are protected by applicable intellectual-property law.

Third-party trademarks, music, names or other material remain the property of their respective owners.

No intellectual-property rights are transferred to you except for the limited personal-use licence described in these Terms.

16. Account sharing and misuse

Course access is intended for the individual learner for whom it was purchased unless a product is expressly sold as a group, school or multi-user licence.

You must not share an account between unrelated users or distribute login credentials in order to avoid purchasing additional access.

I may investigate unusual or excessive account activity where there are reasonable grounds to suspect misuse.

Where there is a serious or repeated breach of these Terms, I may suspend or terminate access after taking reasonable account of the circumstances.

Where appropriate, I will give you an opportunity to resolve the problem before terminating access.

Nothing in this clause allows Proper Guitar Lessons to remove access arbitrarily or to avoid obligations owed to you under consumer law.

17. Uploading videos and other material

Some Proper Guitar Lessons services may allow you to upload videos, audio recordings, photographs, documents, comments or other materials for assessment, feedback or participation.

You retain ownership of material you create and submit.

By submitting material, you grant Proper Guitar Lessons a limited, non-exclusive licence to store, access, copy where technically necessary and review that material for the purposes of providing the service, administering your account and operating the platform.

This licence does not give Proper Guitar Lessons permission to use your submitted videos or other personal material in advertising, social media, testimonials or promotional content.

Separate permission will be obtained before any such promotional use.

You are responsible for ensuring that material you upload is lawful and that you have the right to submit it.

You must not knowingly upload unlawful, abusive, defamatory, malicious or infringing material.

18. Assessments and personalised feedback

Assessments, feedback, scores, recommendations and learning plans provided by Proper Guitar Lessons are intended to help your musical development.

Unless explicitly stated otherwise, they are educational assessments rather than regulated academic or professional qualifications.

Assessment involves professional judgement and different teachers may reasonably reach different conclusions about a player's performance.

Any estimated turnaround time will be provided where appropriate. If no specific completion date is agreed, the service will be provided within a reasonable time.

19. Learning outcomes and results

Proper Guitar Lessons is designed to help students improve their musical knowledge and playing ability, but individual results vary.

Progress depends on factors including practice, previous experience, available time, physical ability, consistency and how the material is applied.

I therefore cannot guarantee:

  • A particular level of ability within a particular period
  • Examination results
  • Admission to a course or institution
  • Professional employment
  • Income from music
  • Specific artistic or career results

Any examples of student progress are illustrative and are not guarantees that every student will achieve the same result.

20. Physical practice and wellbeing

Learning an instrument involves repetitive physical activity.

You are responsible for practising sensibly and within your own physical limits.

If an exercise causes significant or persistent pain, numbness or discomfort, you should stop and, where appropriate, seek advice from a suitably qualified medical professional.

Information provided by Proper Guitar Lessons relating to posture, hand position, practice habits or physical technique is educational and is not medical advice.

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence or any other liability that cannot lawfully be excluded.

21. Community features

If Proper Guitar Lessons provides comments, discussion areas, forums, groups or other community features, you agree to treat other users respectfully.

You must not use these services to:

  • Harass or threaten another person
  • Post unlawful or discriminatory material
  • Spam or advertise without permission
  • Impersonate another person
  • Distribute malware or deliberately compromise security
  • Infringe another person's intellectual-property or privacy rights
  • Share another member's private material without permission

Content may be removed and access to community features may be restricted where reasonably necessary to protect users, comply with the law or enforce these Terms.

22. Third-party services and platforms

Proper Guitar Lessons relies on third-party providers to operate parts of its services. These may include course-hosting platforms, video hosting, payment processors, email providers and other technology services.

While reasonable steps will be taken to maintain access, I cannot guarantee that every third-party system will operate without interruption.

Temporary maintenance, technical problems, internet outages or circumstances outside my reasonable control may occasionally affect availability.

Where a problem materially affects a product or service you have purchased, I will take reasonable steps to restore access or provide an appropriate alternative.

Your statutory rights remain unaffected.

23. External links

The Proper Guitar Lessons website or courses may contain links to third-party websites, videos, software, social-media platforms or other resources.

These links may be provided for convenience or educational purposes.

Unless expressly stated otherwise, the inclusion of a link does not mean that Proper Guitar Lessons controls or endorses the third-party service.

Third-party websites are governed by their own terms and privacy policies.

24. Website availability and accuracy

I take reasonable care to ensure that information published by Proper Guitar Lessons is accurate and useful.

However, occasional errors may occur and website content may be corrected or updated.

The website may also occasionally be unavailable because of maintenance, technical issues or circumstances outside my reasonable control.

Nothing in this section affects information that forms part of a contract with you or removes any rights you have where a product or service is not as described.

25. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or restricts liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Your statutory consumer rights
  • Any other liability that cannot lawfully be excluded

If I fail to comply with these Terms, I am responsible for loss or damage that is a foreseeable result of that failure or of my failure to use reasonable care and skill.

I am not responsible for loss or damage that could not reasonably have been foreseen when the contract was made.

Where you purchase a product primarily as a consumer, Proper Guitar Lessons is not responsible for business losses such as lost profit, lost revenue or loss of business opportunity that arise from using the product for commercial purposes.

26. Events outside reasonable control

I will not be responsible for a delay or failure caused by events genuinely outside my reasonable control, provided that reasonable steps are taken to minimise disruption and resume the affected service.

Such events may include major internet or hosting failures, natural disasters, serious illness, governmental restrictions or other exceptional circumstances.

Where such an event materially prevents a paid service from being provided, I will communicate with affected customers and provide any remedy required by law.

27. Privacy and personal information

Your personal information will be handled in accordance with the Proper Guitar Lessons Privacy Policy.

The Privacy Policy explains what information may be collected, why it is used, how it is protected and the rights you have over your personal information.

28. Suspension and termination

I may suspend or terminate access to a Proper Guitar Lessons account where there is a reasonable basis to do so, including:

  • Serious or repeated breach of these Terms
  • Fraudulent activity
  • Unlawful use
  • Deliberate infringement of Proper Guitar Lessons intellectual property
  • Serious harassment of another user
  • Unauthorised account sharing
  • Non-payment of amounts properly due

Where reasonable and appropriate, I will give notice and an opportunity to correct the breach before terminating access.

Immediate action may be taken where necessary for security, legal compliance or the protection of other users.

Termination does not remove any refund or other rights that you are entitled to under applicable law.

29. Complaints

If something goes wrong, please contact me first so that I have an opportunity to resolve the problem.

Email:

[email protected]

I will make reasonable efforts to respond promptly and resolve complaints fairly.

Nothing in this section prevents you from exercising your statutory rights.

30. Changes to these Terms

These Terms & Conditions may occasionally be updated to reflect changes to Proper Guitar Lessons, its services or applicable law.

The latest version will be published on this website with an updated revision date.

Changes will not retrospectively remove rights that have already arisen under a purchase.

For one-off purchases, the terms applying when your contract was formed will continue to govern that purchase except where a later change is required by law or expressly agreed with you.

If a material change affects an ongoing subscription or service, reasonable notice will be provided where appropriate.

31. Severability

If any part of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions will continue to apply.

32. Waiver

If I do not immediately enforce a provision of these Terms, that does not mean that I have permanently waived the right to enforce it.

33. Third-party rights

Unless expressly stated otherwise, these Terms are between you and Proper Guitar Lessons and do not give any other person a right to enforce them.

34. Entire agreement

These Terms, together with the relevant product description, checkout information, Privacy Policy and any specific terms expressly provided when you purchase, form the agreement relating to your purchase.

Nothing in this provision excludes liability for fraud or fraudulent misrepresentation, prevents you relying on information that the law treats as part of the contract, or reduces your statutory consumer rights.

35. Governing law and jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, the courts of England and Wales will normally have jurisdiction over disputes.

If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom in which you live.

If you live outside the United Kingdom, any mandatory consumer protections that apply to you under the law of your country of residence are not excluded by these Terms.
